RöCognition is a service that involves collaboration between a team of experienced psychologists and lawyers.

Parties involved in a dispute often entrench themselves in their positions, interpreting all facts through the lens of their own goals and expectations – or their perceptions of these goals and expectations. Conversely, focusing solely on the literal wording of regulations and proving one’s point does not facilitate reaching an agreement. RöCognition utilises expert knowledge to analyse possible alternative perspectives on the problem and to make the parties aware that, in dispute resolution, it is not always about being right.

How does it work?

RöCognition can be used, among other things, for effective construction and presentation of arguments in court disputes, as well as in mediations and negotiations. By analysing statements, declarations, procedural documents, the progression of the case, and conversations with clients or both parties, our team of psychologists, in collaboration with legal experts, develops potential scenarios for how the situation might unfold and identifies suitable arguments. Analysing the potential goals and motivations of the parties enables conscious risk management and the selection of optimal measures and solutions in the decision-making process. It often brings the parties closer to reaching an agreement by making them aware of their real objectives, which is usually more beneficial for them than a prolonged court battle.

RöCognition in practice

One of the most interesting cases we worked on together with the RöCognition team was a successful settlement between the parties involved in a conflict within a leading Polish company from gastronomy sector. Initially, there was no indication that the conflict could be resolved amicably, as the conflict was not only about the law: the company was a family business, so personal relations and tensions between the parties were crucial for their willingness to come to an agreement and to make any concessions. However, thanks to intensive work with psychologists, we were able to achieve a settlement that went far beyond expectations of the parties. Their work focused on analysis of parties’ actual goals and intentions, which helped all the involved persons to focus on the essentials and avoid discussions which could only make the conflict deeper.
