Marek specialises in civil court matters and bankruptcy and restructuring proceedings. He advises and represents clients in infrastructure disputes, having worked on claims with a total value exceeding PLN 250 million, and in complex insolvency proceedings. In 2018 Marek advised and represented Polimex-Mostostal S.A. on a precedent-setting settlement with the General Directorate for National Roads and Highways (GDDKiA) related to contracts for sections of the A1 and A4 motorways, and the S69 expressway, where the total value of claims exceeded PLN 1.1 billion. Since 2016 he has represented the Industrial Development Agency in proceedings with entities from the HAWE Capital Group; in 2018 he advised Alior Bank S.A. on GetBack S.A.’s restructuring proceedings and the restructuring of RUCH S.A. Marek has experience in conducting pre-pack liquidation proceedings and managing the process of restructuring the obligations of entities that make up a capital group. He also represents clients in preparatory and criminal proceedings against individuals whose actions have led to harm to creditors. He works on claims for damages from changes in planning permission, proceedings against the Agency for Restructuring and Modernisation of Agriculture on the awarding of agriculture-environmental subsidies and corporate disputes concerning joint responsibility of management board members for a company’s obligations.
Marek specialises in issues related to building contracts, in particular the use of guarantees for work, bases for claims and expiration of claims on the basis of the so-called Special Law of 28 June 2012, and the nature of the bank guarantee that ensures the performance of the agreement. He also focuses on questions of the competences and role of the creditors’ committee in restructuring proceedings. Marek has been connected with Rö since 2013, earlier working with a leading Polish law firm (2010-2013). He completed his legal apprenticeship with the Warsaw Bar Association and is a graduate of the Faculty of Law and Administration at Warsaw University.
